2. Products and Availability
All physical goods are produced in small batches and may be seasonal or limited in availability. Product descriptions, photographs, and representations are provided for general reference. Due to the handmade nature of many items, slight variations in color, texture, or design may occur.
We reserve the right to limit quantities or discontinue products at any time.
3. Orders and Payments
All orders are subject to acceptance and availability. Payment is required at the time of purchase. Prices are listed in U.S. dollars.
We reserve the right to refuse or cancel orders at our discretion, including in cases of pricing errors or suspected fraudulent activity.
4. Shipping and Delivery
Shipping timelines are estimates and may vary due to production schedules, carrier delays, weather, or seasonal demand.
Once an order has been transferred to a shipping carrier, Moon Tree Rising LLC is not responsible for carrier-related delays, damage, or loss beyond what is required by law.
Local pickup options, when available, must be collected within the timeframe provided.
5. Classes, Workshops, and Training
Classes, workshops, range training, and farm experiences offered under the Moon Tree Farm name are educational in nature.
Participation may be subject to:
- Age requirements
- Safety rules
- Liability waivers
- Instructor discretion
Moon Tree Farm reserves the right to remove participants who do not comply with safety guidelines or conduct standards.
Outdoor, agricultural, and training activities involve inherent risks. Participants assume responsibility for those risks unless otherwise prohibited by law.
6. Lodging and On-Site Experiences
Lodging stays and on-site experiences are subject to separate booking terms provided at the time of reservation. Guests must comply with all posted property rules and safety guidelines.
7. Limitation of Liability
To the fullest extent permitted by Florida law, Moon Tree Farm and Moon Tree Rising LLC shall not be liable for indirect, incidental, consequential, or special damages arising from:
- Use of this website
- Purchase or use of products
- Participation in classes or activities
- Lodging stays
Nothing in these terms limits liability where such limitation is prohibited by law.
8. Sales & Fulfillment Notice
All physical goods sold through this website — including but not limited to soaps, lotions, baked goods, and related farm-made products — are produced and sold by:
Moon Tree Rising LLC — A Florida Limited Liability Company
Moon Tree Farm is the operating farm and venue name used for educational programs, workshops, lodging, and on-site experiences.
Online product sales, payment processing, order fulfillment, and related customer service for physical goods are handled exclusively by Moon Tree Rising LLC.
9. Herbie — Electronic Document Signing Tool
Herbie is an electronic document signing tool available at moontreefarm.com/herbie/ and operated by Moon Tree Farm. Use of Herbie constitutes acceptance of these additional terms.
Electronic Signatures. Signatures created through Herbie are intended to comply with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and applicable Florida law. By signing a document through Herbie, you acknowledge that your electronic signature is legally binding to the same extent as a handwritten signature.
Platform Only — No Legal Advice. Herbie is a delivery and signing platform only. Moon Tree Farm is not a law firm and does not provide legal advice. Nothing about Herbie — including its document templates, variable fields, or signing workflow — constitutes legal counsel. Users are solely responsible for ensuring that any document they create, send, or sign is legally sufficient for their intended purpose. We strongly recommend consulting a licensed attorney before executing any legally significant agreement.
Document Responsibility. Moon Tree Farm makes no representations regarding the content, accuracy, completeness, enforceability, or legal validity of any document sent or signed through Herbie. Moon Tree Farm is not a party to any agreement executed through the platform and assumes no liability arising from the substance or outcome of any such agreement.
No Guarantee of Enforceability. Electronic signatures created through Herbie are designed to comply with applicable law, but Moon Tree Farm does not warrant that any document signed through Herbie will be deemed enforceable in any particular jurisdiction, court, or context. Enforceability depends on factors outside our control, including the nature of the document, the parties involved, and applicable law.
Data and Records. Signed documents, signature records, IP addresses, timestamps, and audit data are retained for platform integrity and legal record-keeping purposes. Users are responsible for saving and maintaining their own copies of signed documents. Moon Tree Farm does not guarantee indefinite retention of signing records.
Service Tiers. Herbie is available under a free tier (limited sends per month) and a paid Pro tier. Pricing and feature limits are displayed at moontreefarm.com/herbie/ and are subject to change with notice.
Limitation of Liability. To the fullest extent permitted by law, Moon Tree Farm shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of Herbie, including but not limited to: disputes between signing parties, failure of a document to be deemed legally enforceable, unauthorized access to signing links, errors in document content, or reliance on any document executed through the platform. Use of Herbie is at your own risk.
10. Teen Tab — Family Allowance and Chore Management Tool
Teen Tab is a household allowance and chore tracking tool available at moontreefarm.com/teen-tab/ and operated by Moon Tree Farm. Use of Teen Tab constitutes acceptance of these additional terms.
For Personal Family Use Only. Teen Tab is intended solely for private household use by parents or guardians managing allowance and chore tracking for their own minor children. It is not intended for commercial, institutional, or third-party use.
No Financial Advice. Teen Tab is an organizational tool only. Moon Tree Farm does not provide financial, tax, or legal advice. Allowance amounts, deduction structures, and payment decisions are entirely at the discretion of the account holder. Moon Tree Farm assumes no responsibility for how families choose to use the platform.
Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including activity by family members invited through the family invite system. Invited family members access the platform under your primary account — you are responsible for managing and revoking that access as needed.
Minor Data. Teen Tab stores names, chore records, and transaction history for children managed under a parent or guardian account. This information is entered solely by the account holder and is not shared with third parties. Moon Tree Farm does not knowingly collect personal information directly from minors.
Service Tiers. Teen Tab is available under a free tier and a paid Pro tier ($20/year). Pricing and feature limits are displayed at moontreefarm.com/teen-tab/ and are subject to change with notice. Pro licenses are non-refundable except where required by law.
Limitation of Liability. To the fullest extent permitted by law, Moon Tree Farm shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use of Teen Tab, including but not limited to: loss of data, errors in transaction records, disputes between family members, or reliance on any information tracked within the platform. Use of Teen Tab is at your own risk.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles.
