Contract Terms

1. Boarding Type & Rate

Pasture-Based Partial Board. Natural pasture environment with consistent daily care and minimal confinement.

2. Feed & Care Responsibility

Base board assumes owner-supplied feed. If the Moon Tree Standard Feed add-on is selected, Moon Tree Rising LLC provides standard feed only. Specialty grain, premium hay, supplements, or complex feeding requirements are not included and may result in additional charges.

Owner-supplied feed must be clearly labeled, properly stored, and simple to administer. If feed is missing or runs out, feeding may be skipped, reduced, or substituted and billed to the owner.

3. Payment Terms

Monthly board is due on the 1st of each month. Payments received after the 10th are subject to a $25 late fee.

4. Prorated First Payment & Move-In Requirements

Initial payment covers prorated board for the remainder of the start month plus full board for the following month. No horse will be accepted without full payment. Space is not reserved until payment is received.

5. Cancellation Policy

Cancel anytime. No long-term commitment. Seven days’ notice is appreciated.

6. Boarder Responsibilities

Boarder agrees to maintain the horse in good health, keep vaccinations and deworming current, maintain regular farrier care, provide required feed unless Moon Tree Standard Feed is selected, and carry any desired equine insurance.

7. Emergency Care Authorization

If owner cannot be reached in an emergency, Moon Tree Rising LLC may obtain veterinary care as necessary. Owner is responsible for all veterinary costs.

8. Care, Custody, and Control

Moon Tree Rising LLC is not an insurer of the horse. Owner acknowledges horses may be injured, become ill, or die due to natural causes, pasture conditions, weather, or interaction with other horses. Moon Tree Rising LLC is not responsible for injury, illness, death, escape, or theft unless caused by gross negligence or willful misconduct.

9. Abandonment & Non-Payment

If board is unpaid for 15 days or owner fails to communicate for an extended period, the horse may be considered abandoned. Moon Tree Rising LLC may retain possession and pursue remedies as permitted by Florida law.

10. Liability, Assumption of Risk, Release, and Hold Harmless

Boarder acknowledges equine activities are inherently dangerous. Florida Statutory Warning: “Under Florida law, an equine activity sponsor or equine professional is not liable for injury to, or death of, a participant resulting from inherent risks of equine activities.”

By signing, Boarder assumes all risks; releases Moon Tree Rising LLC and its representatives from liability except in cases of gross negligence or willful misconduct; and agrees to indemnify and hold harmless Moon Tree Rising LLC from all related claims.

11. Property Conditions

Moon Tree Farm is a working farm. Natural hazards exist including uneven ground, mud, animals, insects, equipment, and weather. No guarantee of complete safety is provided.

12. Horse Behavior & Removal

Horses must be safe and manageable. Aggressive or destructive horses may be required to leave. Moon Tree Rising LLC may terminate this agreement at its discretion.

13. Guest / Visitor Policy

Boarder is responsible for guests on the property. Boarder assumes responsibility for injuries or damage caused by their guests.

14. Agreement Acceptance

Boarder confirms they have read this agreement, understand what is and is not included, agree to the payment terms, and understand boarding does not begin until the signed agreement and payment are received.

I have read and understand this agreement. I understand what is included and not included in this boarding arrangement. I understand my feed must be clearly labeled, properly stored, and simple to administer. If it runs out or is unclear, feeding may be skipped or substituted and billed to me. I agree to the payment terms including proration, the $25 late fee after the 10th, and that my space is not reserved until the signed agreement and full initial payment are received. I agree my electronic signature is the legal equivalent of my handwritten signature.
